Information on the Processing of Personal Data:
I. DEFINITIONS:
Personal Data: Refers to any information related to the identified or identifiable real person.
Processing of Personal Data: Refers to all kinds of processes performed on personal data such as obtaining, recording, storing, retaining, modifying, reorganising, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data by fully or partially automatic means or by non-automatic means provided that they are part of any data recording system,
Data Controller: Refers to real or legal person responsible for identifying the purposes and means of personal data processing and installing and managing data registry system.
Data Processor: Refers to the natural or legal person who processes Personal Data on behalf of the data controller under the authority conferred by the data controller,
The Law on the Protection of Personal Data (‘the Law on the Protection of Personal Data’): Refers to the Law on the Protection of Personal Data No. 6698,
Data Recording System: Refers to the recording system in which personal data are structured and processed according to certain criteria,
Anonymisation: Refers to making personal data impossible to be associated with an identified or identifiable natural person under any circumstances, even if it is matched with other data.

III. PURPOSE OF PROCESSING YOUR PERSONAL DATA
As Holidayhookah.com / BURAK DOĞRU, personal data are processed within the scope of the general principles set out in Article 4 of PDPL no. 6698 and the conditions set out in Articles 5 and 6 of PDPL No. 6698 for the purposes of providing, offering, developing the products and services of our business, providing technical support for our products and services, presentation, training and management of customer evaluation and complaint processes, informing about our existing and future products and services, sales, rental, marketing activities, referencing, sending campaign announcements via commercial electronic messages, operating processes related to human resources and similar purposes. The general principles in Article 4 and the conditions set out in Articles 5 and 6 of the PDPL No. 6698 are processed within the scope of the conditions set out in Articles 5 and 6.
In the presence of one of the following conditions in paragraph 2 of Article 5 of PDPL No. 6698, it is possible for holidayhookah.com to process personal data without seeking the explicit consent of the person concerned.
1-) It is explicitly prescribed by the law,
2-) It is mandatory to protect the life or body integrity of the person or another person for whom legal validity has not been recognized for its consent and being in a position of not capable of explaining its consent due to the actual impossibility,
3-) Processing of personal data pertaining to the parties of the contract is required, provided that it is directly related to the establishment or performance of a contract,
4-) It is compulsory for us to fulfil our legal obligation as a data controller,
5-) It has been made public by the data owner itself,
6-) Data processing is mandatory for the establishment, use or protection of a right,
7-) It is mandatory to process data for the legitimate interests of data supervisor, provided that it does not harm the fundamental rights and freedoms of the data owner.
IV. TRANSFER OF YOUR PERSONAL DATA
Your personal data collected and processed will not be transferred to third parties, except when requested by authorised public institutions and organisations.
V. METHOD AND LEGAL REASON FOR PROCESSING YOUR PERSONAL DATA
Your personal data can be collected automatically or non-automatically, in written, verbally or electronically, when you access the website www.holidayhookah.com used by Holidayhookah.com / BURAK DOĞRU, when you call our call centre, when you access through social media accounts, when you participate in trainings, seminars or organisations organised by us, when you visit our company, through job applications and other similar channels.
Your personal data may be processed by www.holidayhookah.com for the following purposes;
• Site membership-rental Forms
• Website Contact Forms
• Websites E-Newsletter Registration Forms
• Forms of site social media pages
• Your personal data collected through channels such as Website Cookie Policy Forms and for different legal reasons may be processed within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDPL and for the purposes specified in this Clarification Text. Personal data will be stored in accordance with the periods stipulated in the relevant legislation, and if there is no regulation in the legislation regarding the duration, the data will be processed for the period required for the realisation of the purpose of the activity carried out when the data is processed, and then it will be destroyed or anonymised.
VI. YOUR RIGHTS AS A PERSONAL DATA SUBJECT
Within the scope of Article 11 of the PDPL No. 6698, you have the following rights as a data subject.
1-) Being aware of whether personal data are processed,
2-) Requesting information if your personal data has been processed,
3-) Being aware of the purpose of the processing of personal data and whether they are used in accordance with their purpose,
4-) Knowing the third parties to whom your personal data are transferred,
5-) Requesting correction of personal data in case of incomplete or incorrect processing,
6-) In the event that the reasons requiring the processing of personal data disappear, requesting the deletion, destruction or anonymisation of this data and requesting that this request be communicated to the transferred third party if the transfer has been made,
7-) Objecting to the occurrence of an unfavourable result by analysing the processed data exclusively through automated systems,
8-) In case of damage due to unlawful processing of personal data, demanding compensation for the damage. You can submit your requests regarding your rights mentioned above, together with documents proving your identity, by registered e-mail (with secure electronic signature or mobile signature) to the e-mail address burak@holidayhookah.com or in person or through a notary public.
The requests you submit to our company will be finalised free of charge as soon as possible and within thirty days at the latest, depending on their nature. If a fee is stipulated by the Personal Data Protection Board, a fee may be charged by our Company, as well as additional information may be requested in order to understand and confirm the identity of the personal data owner regarding your request and to share the information with the right person.
